These Terms of Use and Sale apply to Australian customers who access Cozey websites, place orders for products, request related services, or otherwise engage with Cozey in connection with goods or services offered to Australia. The contracting entity for Australian sales is Cozey Australia.
Orders are subject to availability and acceptance. Cozey may correct genuine pricing or catalog errors before shipment. If an order cannot be accepted, Cozey will notify the customer and refund any amount paid for the unaccepted order.
Cozey aims to present product descriptions, dimensions, finishes, delivery estimates and imagery as accurately as reasonably possible, while acknowledging that colors can vary by screen and minor updates may occur. Cozey does not rely on sweeping statements that all product quality expectations are disclaimed.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory guarantee, or other right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted, or modified.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Risk of loss for goods passes on delivery to the customer or as otherwise required by law. Delivery timeframes are estimates only. If goods are damaged on arrival, customers should contact Cozey as soon as possible. This clause does not affect any rights or remedies under the Australian Consumer Law.
Eligible products may be returned within 30 days after delivery under our Returns Policy, including after assembly and trial, provided they are returned in new condition. If goods are faulty, unsafe, misdescribed, or do not meet a consumer guarantee, or if related services such as scheduled delivery or white-glove service are not provided with due care and skill or within a reasonable time, contact us at [support email], as you may be entitled under the Australian Consumer Law to a repair, replacement, refund, cancellation of services, or compensation for loss or damage. Any voluntary change-of-mind policy is in addition to, and does not limit, your rights under the Australian Consumer Law.
Users must not misuse the website, interfere with security, upload malicious code, scrape the site in breach of applicable law or site restrictions, impersonate others, or use the site for unlawful purposes.
Cozey retains ownership of the website, branding, product imagery, text, graphics, software and related content, except where third-party rights apply. Customers receive only the limited right to use the website for personal, lawful shopping and account-management purposes.
If customers submit reviews, photos, comments or feedback, Cozey may use them under a non-exclusive, worldwide, royalty-free licence for operating, improving, marketing and promoting the business, subject to applicable privacy law and any separate written promises.
Third-party tools, payment options, financing providers, logistics trackers or linked sites may be subject to separate terms. Cozey can disclaim responsibility for third-party services to a reasonable extent, but does not disclaim its own legal obligations for the overall transaction where the customer is still dealing with Cozey.
To the maximum extent permitted by law, Cozey excludes liability for indirect or consequential loss that is too remote to be recoverable. This clause does not limit liability that cannot be excluded under law, including ACL rights and remedies.
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction. Nothing in this clause deprives Australian consumers of mandatory protections or remedies available under the Australian Consumer Law or any other applicable law.
Cozey may update the Terms from time to time by posting the updated version and updating the effective date. Material changes apply prospectively and do not reduce rights for completed purchases or accrued claims.
